Defendant was convicted by a jury of manslaughter, MCL 750.321; MSA 28.553. He was sentenced to 10 to 15 years imprisonment and appeals as of right. This prosecution arose from the fatal stabbing of Marvin Davis, which occurred during the evening hours of August 5, 1981, in an alley adjacent to 6919 Frederick in Detroit, Michigan. Tanitha Pierce, defendant's girlfriend and the mother of his child, became embroiled in an argument with her mother, Emma White, concerning the quality of care rendered by Tanitha's babysitter. The deceased, who was Emma White's boyfriend, intervened in the argument which touched off a confrontation between defendant and the deceased.
